Joscha Hasenkamp A. General Information on Data Processing1) Personal DataPersonal data means any information relating to an identified or identifiable natural person. This includes information such as your name, address, telephone number and email address, as well as the IP address that can be assigned to a connection. Information that cannot be directly linked to a person’s identity – such as preferred websites or the number of users of a page – does not constitute personal data. 2) Scope of the Processing of Personal DataWe generally collect and use personal data of our users only to the extent necessary to provide a functional website and our content and services. The collection and use of personal data of our users regularly only takes place with the user’s consent. An exception applies in cases where prior consent cannot be obtained for factual reasons and the processing of the data is permitted by legal provisions. 3) Legal Basis for the Processing of Personal DataWhere we obtain the consent of the data subject for processing operations involving personal data, Art. 6(1)(a) GDPR serves as the legal basis. For the processing of personal data necessary for the performance of a contract to which the data subject is a party, Art. 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for carrying out pre-contractual measures. Where processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party and such interests are not overridden by the interests or fundamental rights and freedoms of the data subject, Art. 6(1)(f) GDPR serves as the legal basis. 4) Erasure of Data and Storage PeriodThe personal data of the data subject will be erased or blocked as soon as the purpose of storage ceases to apply. Storage may also be carried out if this is provided for by the European or national legislature in EU regulations, laws or other provisions to which we are subject. Data will also be blocked or erased if a storage period prescribed by the aforementioned standards expires, unless further storage of the data is required for the conclusion or performance of a contract. B. Provision of the Website and Creation of Log FilesEach time our website is accessed, our system automatically collects data and information. The following data are collected:
These data are stored in the log files of our system. They are not stored together with other personal data of the user. Legal Basis for Data ProcessingThe legal basis for the temporary storage of the data and log files is Art. 6(1)(f) GDPR. Purpose of Data ProcessingThe temporary storage of the IP address by the system is necessary in order to deliver the website to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session. Storage in log files takes place to ensure the functionality of the website. In addition, the data help us to optimize the website and to ensure the security of our IT systems. These purposes also constitute our legitimate interest in data processing in accordance with Art. 6(1)(f) GDPR. Storage PeriodThe data are erased as soon as they are no longer necessary for achieving the purpose of their collection. In the case of data collected for provision of the website, this is when the respective session has ended. In the case of storage of data in log files, this is the case after no more than six weeks. Longer storage is possible. In this case, IP addresses of users are erased or anonymized so that assignment to the accessing client is no longer possible. Possibility of Objection and RemovalThe collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website. The user therefore has no possibility to object. C. Use of CookiesOur websites use “cookies” in several places.
